West Ham are not considering suing the FA over their failed case involving Lucas Paqutea, nor will they sue them over the £85m from Manchester City they missed out on due to the case.

Yesterday, the Times claimed that West Ham and Lucas Paqueta were considering suing the Football Association.

Two separate club insiders confirmed West Ham will not be fighting the English football authority in the courts, backing up what Claret and Hugh said back on August 1st

West Ham believes it is not a good look for the Premier League or West Ham to sue its own football authority, and there is an unwritten rule that it is not done unless there have been criminal acts or serious cases of professional negligence.

Paqueta has lost out significantly

Lucas Paqueta will need to make his own decision, but recovering his £1 million of legal costs would be near impossible, according to one legal source we spoke to.

The regulations make it clear that players must bear their own costs and expenses in tribunals, and it is not like a court of law, where costs are awarded to the winning side.

Paqueta and his representatives made the decision to assemble a Legal dream team, which includes Nick DeMarco, who doesn’t come cheap.

The other avenue for compensation is that the investigation that caused his £85m move to Manchester City to fall through, with Paqueta missing out on a signing-on fee and increased wages worth millions.

Any case would be very expensive and difficult to win, as it would create a dangerous legal precedent for the FA, which would fight it with all they have.

Nick DeMarco is used to taking on impossible cases and winning, but Paqueta could be investing a large sum of his own money to try.

He will most likely decide the litigation risk is too high!

    I think that everyone will be happier to move on and consign this fiasco into history. One for the end of life biographies. Time now to enjoy football and enjoy life.

    The FA employees are very, very fortunate people.

    We’re ok with suing our stadium landlords on a regular basis though.

    There is already an independent report that criticises the FA handling, whether we choose too or not we should, the FA are incompetent and have cost the club money and reputation, they are unlikely to be able to win this case and would likely be advised to settle out of court, it may be a precedent but there was never sufficient evidence and the player had evidence over an entire career of picking up stupid bookings, this case is as close to black and white as it could be, the FA should be fined heavily to prevent this scenario ever happening again.

    Man City could also sue, blaming their decline in form due to not having Paqueta in their team, surely there’s no other explanation for it!!

    I would love to see it but am also pleased it’s not going to happen because of the aftermath But that certainly tells me the FA think they are Gods and can do EXACTLY what they like with who they like Surely this shouldn’t be allowed there must be a footballing body that can stop them They are certainly getting far too big for their boots
