West Ham and Lucas Paqueta are unlikely to pursue legal cases against the Football Association (FA)
The FA independent tribunals operate under specific procedural rules to adjudicate disputes within the football community.
Legal fees are generally not recoverable. The Football Association’s Procedural Rules Governing the Football Tribunal clearly state that parties bear their own costs. This means that whether a player wins or loses their case, they are responsible for their own legal representation and associated expenses.
While former players have previously sued the FA that is restricted to specific cases like when the FA were accused of failing to protect players from brain injuries caused by repetitive head trauma.
If a current player believes a decision by the FA is unlawful or breaches their employment rights, they may be able to pursue legal action in a civil court or an employment tribunal.
In Paqueta’s case the civil courts are likely to want to get involved if the regulations are clear that players must bear their own legal costs and expenses so any legal challenge could be fruitless.
Likewise West Ham United will not take legal action against the Football Association as there is an agreement that football clubs do not sue football authorities.
West Ham are understood to have paid some of Lucas Paqueta’s legal fees.
So whatever way this went Paqman is the loser no matter what.For someone cleared of all major charges,the stress to him and family,big move its shocking he has to pay out .

Paquetas lawyer said in an interview they will wait until they find out what the two charges amount to before they decide whether to take legal action against the FA.
Paqueta will want to leave all this behind and start afresh somewhere else. WH will want to maximise the transfer fee. Having yet another court case hanging over him (for another two years at least) is neither in the interest of the player or the club.
Forget the agreement They should sue seeing how much trouble and grief the FA have caused. If not they will continue to make players and clubs life a misery.

So after all the speculation of Lucas Paqueta and West Ham United suing the FA for liability it turns out that the FA are responsible for sweet FA. Unbelievable! 🤬
The dissuasions from suing the FA enable the FA to behave more extremely than they would be able to do otherwise, it’s not a level playing field.
So the FA can ruin 2 years of a players life, cost the player a fortune in legal fees, cost the player their dream move to another club plus the extra earnings that would bring, cost West Ham in lost player sales (as the players value is now considerably less), cost West Ham in loss of player form…………………. and there are no consequemces for the FA!!??

This debacle of an investigation clearly impacted the player and his families mental wellbeing. The FA have been incompetent throughout and have not taken account of the toll this would have on those accused. Justice delayed is justice denied. He should sue on the basis that the FA breached their duty of care to the player and his family.
