The French club have revealed their intentions in a club statement but the Irons are confident they will win the argument should the case go before the football authorities.
Metz claim the Hammers decided very late that a loan deal would suit them better than offering the permanent contract that had been under discussion from the start.
We were told that the despairing player was in tears as his big chance slipped away and that there is no real surprise that Metz have decided to act.
However, the Hammers believe is little chance of the French club winning their case which would take years to be heard anyway.
Nothing was signed under FA or Premier League rules and the club believes it had every right to pull out.
Metz are likely to claim damages but these are hard to quantify and our source said: “The club will fight the case all then way and would expect to win.”
